New heavy vehicle code takes wider approach

An updated code of practice for the trucking industry extends beyond road transport businesses to other industries that rely on heavy vehicles.

The National Heavy Vehicle Regulator’s first Master Code of Practice update since 2018 provides clearer and more relevant guidance for businesses including manufacturing, construction, mining, retail and logistics, according to freight insurance specialist NTI’s supply chain technical manager Aaron Louws. 

“If you send or receive freight, outsource transport or impose requirements that affect delivery times or loading practices, the code provides guidance on what you can do to balance safety, productivity and compliance,” he said.

The Heavy Vehicle National Law sets out requirements such as limits on driving hours and axle loads, and includes a primary duty for all parties to ensure safety as far as reasonably practicable.

NHVR acting chief safety and productivity officer Kelli Walker say the updated code bridges the gap between the legal duty and everyday business decisions.

Mr Louws says the code moves away from role-based obligations to activities, prompting businesses to more broadly consider what they do and how it could affect their heavy vehicle operations.

Businesses should identify which transport activities apply to them, review current controls and document how risks are managed.

“You don’t have to implement every control in the code, but you should be prepared to explain that what you’re choosing to do is equally as effective for your business at managing the risk.”

The code applies in all jurisdictions except WA and the NT.
