State consults on overhaul of injured workers’ rights
Victorians can provide feedback on a new draft code of claimants’ rights under the state workers’ compensation scheme.
The provisional code outlines rights under the WorkCover program and service standards for WorkSafe, its agents and self-insurers participating in the scheme.
Claimants’ rights include fair and respectful treatment, access to a support person, accurate communication and information, and ability to make complaints.
The code outlines processes for filing complaints with WorkSafe or the Victorian Ombudsman, plus potential remedies.
WorkSafe CEO Cathy Henderson says the regulator is “committed to delivering a scheme that supports injured workers and ensures people are treated with dignity and respect at every stage of their claim.
“By formalising these rights, claimants can feel confident and empowered throughout the process.
“WorkSafe values the perspectives of those with lived experience and we encourage workers, employers and the community to have their say and help shape a code that will improve outcomes for all claimants.”
The code was developed after legislation was passed last year in a wider overhaul of WorkSafe’s support structure.
WorkSafe says it has already received feedback from representative groups including the Victorian Trades Hall Council and the Workplace Incidents Consultative Committee.
Public comments can be made until May 27, and the code is expected to take effect later this year.
